The investigation that gave rise to this SEC lawsuit concerns Vuuzle TV, Vumu Music and its film studio and television production company in Dubai. The SEC filed a fraud complaint against the company and Flynn and Marchitto without ever seeking any information from Vuuzle during its investigation.

There was no request from Vuuzle to provide information voluntarily. There was no administrative assignment in Vuuzle. Voluntary requests or administrative subpoenas to the company with active business activities are the usual features of a fair regulatory investigation that should precede any enforcement action by the SEC.

There wasn’t even a Wells notice to give Vuuzle a chance to dissuade the SEC from filing a complaint. Undoubtedly, to the dismay of the SEC, Vuuzle responded to the complaint, disputing the SEC account and claiming Vuuzle is a real business with brick and mortar buildings housing a state of the art studio in the United Arab Emirates, operating in the Philippines and Las Vegas, and employing staff in its multimedia creative, marketing and programming departments.

Now the SEC wants this court to put its imprimatur on the SEC’s unlimited and discretionary use of discovery the SEC will receive in litigation – under and subject to the Fed. R.Civ. P. 26 (b) (1) – for purposes well beyond what the SEC itself had previously decided was unnecessary and irrelevant during and to advance its investigation. Including a new motion for a preliminary injunction.

Since the case was filed by Daren Staren, an inexperienced young lawyer, nothing has been done. she wasted time, government money, meetings with the judge in a total effort to save face and create a narrative to support the fake news from the DOJ that created a fake act. She also stole money from the company’s pursuit bank account in an all-out effort to harm the company and good shareholders. These scary women should be put in jail for what they did behind closed doors.

The show seems to be going well, as the masters and jugglers played by SEC and FBI attorneys put Vuuzle at the center of a fraud case. What they knew was when they shut down the business and tried to manipulate it, thinks Ronnie Flynn like a lion.
